¶1. Zan Morgan appeals a judgment of conviction for possession of THC, second offense, in violation of Wis. Stat. § 961.41(3g)(e) (1999-2000).*fn1 Morgan contends the trial court erred in denying his motion to suppress an inculpatory statement he made in response to a police officer's question without being given Miranda warnings.*fn2 We conclude Morgan was in custody when questioned by the officer and therefore his statement must be suppressed. Accordingly, we reverse and remand for a new trial.
